Use of The Precedent Website
The Precedent Website includes products which are available for purchase from various Brand Partners (“Brand Partners”). If you place an order for a product on our website (a “Product”), you are placing any order with the Brand Partner, and not us. We make the products available for purchase, by taking orders and collecting payment, as the agent of the Brand Partner, and not on our own behalf. The resulting legal contract is between you and the Brand Partner from whom you are purchasing the goods, and is also subject to the conditions of each Brand Partner.
Before making a purchase from a Brand Partner, you should review any Brand Partner’s conditions on the product page, as their individual conditions may vary. These terms govern your purchases from a Brand Partner. The Precedent is not liable for any costs, damages or other loss in connection with the purchase of Products from a Brand Partner or your use of the Site.
The products on the website are only available for sale to individuals who can make legally binding contracts. The products are not available to persons under the age of 18 years and any other persons who are legally prohibited from entering into binding contracts. By making an on-line purchase with any Brand Partner, you accept these Terms & Conditions and acknowledge that you are over the age of eighteen (18) years and able to make a legally binding contract.
To use some of the services or features made available to you on this Site you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Prices of products and delivery charges displayed on this website are in AUD and are inclusive of GST on the sale. All prices are current at the time of issue, but may change at any time and are subject to availability.
All orders are subject to acceptance and availability. Items in your shopping basket are not reserved and may be purchased by other customers. Any order placed by you in the manner described in this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this website at the time you place your order on these Terms and Conditions.
The Precedent reserves the right to accept or reject your order for any reason or refuse service to anyone at any time at our sole discretion, for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Brand Partners may also refuse to process an order for any reason or refuse service to you. Additionally, your financial institution may also decline to process payment requests.
Your contract only comes into existence when it forwards confirmation of receipt of your order and payment.
Purchases may be made via Paypal, Visa and MasterCard. All prices are in Australian dollars ($), and are payable in Australian dollars ($), plus any applicable taxes. You must not pay, or attempt to pay, for an order through any fraudulent or unlawful means. If your payment is not able to be successfully processed then your order may be cancelled.
The payment method you use may be subject to certain terms and conditions by the provider of that payment method. The Precedent does not review or control, and is not responsible in any way for, the functioning of any payment method or the terms and conditions of use of any payment method.
Delivery and Shipping
The goods available on The Precedent Website are sold by The Precedent as an agent on behalf of various Brand Partners.
Most products have free shipping available. Please refer the product description when purchasing an item for any individual shipping details. Orders are dispatched within 1 business day of the Brand Partner’s reciept of your order and shipping times are estimated at between 1-7 business days depending on your location within Australia. Orders which are made-to-order may have a longer delivery times, please refer to the product description for delivery times. Any delivery times displayed on the website are estimates only.
Your order is shipped directly from the Brand Partner so delivery times may vary and you may receive several parcels if you purchased from separate Brand Partners.
Please allow up to 14 days to receive international orders.
Please ensure that the shipping address you provide is correct as we are unable to redirect orders once they are dispatched.
Before we can dispatch your purchases, we may need to confirm your details with your card issuer. We will do our best to keep delays to a minimum. Delivery times start from the moment an order is accepted.
Refund, Returns and Exchanges
Our policy is to return within 7 days of the original receipt. Please also refer the product description when purchasing an item for any individual return details. Made-to-order items are excluded from returns.
All returns must be sent back to the original Brand Partner’s returns address in a new, unused, unmarked and unopened condition. Before you return the item you must notify us via email at email@example.com. Please include your Name, Order Number and Reason for Return. A Return Authorisation Number will then be issued. Return shipping costs are not included.
It is suggested that you send your return package by registered post in it’s original packaging to ensure they are adequately protected in transit. The Precedent cannot be held responsible for any product that is lost or damaged in transit. The Precedent is not responsible for any item that is not returned in a new, unused and unmarked, unopened condition. Please note we cannot offer returns or refunds if returns are requested out of the specified timeframes.
We have made every effort to display as accurately as possible the colors of our products that appear on The Precedent Website. However, as computer monitors vary, we cannot guarantee that your monitor’s display of any color will be completely accurate.
Out of Stock Items
We endeavour to make sure that all products listed on our website are currently in stock and pricing is true and correct. In the rare circumstance that an ordered item is not available or we are unable to fulfill your order we will notify you within 1 business day.
Damaged or Faulty Items
In the unlikely event that the product you have purchased is faulty or is different to its description and or image, we are happy for you to return it within 7 days of receipt of the purchase including return shipping costs.
All items are quality controlled and checked for faults before they are dispatched to customers. Should you receive an item that is not in perfect condition please contact us immediately at firstname.lastname@example.org.
If the item you wish to return is faulty, the appropriate Brand Partner will either require photo proof of the faulty item or request it returned to view the product. It is suggested that you send your return package by registered post in it’s original packaging as The Precedent cannot be held responsible for any product that is lost or damaged in transit.
The Precedent is not involved in making decisions on whether a return, refund or exchange should be accepted or declined. The Precedent is not liable in any way for any costs, damages or other loss in connection with your return, refund or exchange of any items purchased on The Precedent website.
All shoes should be tried on a carpeted surface and if returned are required to return in original and new condition with an undamaged shoebox, as it is considered part of the product. Shoes with marked soles or in a damaged shoe box may not be accepted and sent back to the customer.
Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within six months of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty.
Where possible, the Brand Partner will offer to repair or replace faulty items. Delivery of replacement items are free of charge.
A refund will either be credited to the original purchaser’s credit card or your The Precedent account and will include any shipping costs. Please note credit card refunds may take up to 10 business days for your bank to complete. We are unable to influence these processing times.

Any information, we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. Where we collect personal information on behalf of Brand Partners, we will provide that personal information to them. We ask our Brand Partners to only use such personal information for the purposes of providing you with the products you order.
